Минэкономразвития России предлагает уточнить порядок применения приобретательной давности в качестве основания для возникновения права собственности на недвижимые вещи.
В частности, в ст. 234 Гражданского кодекса предлагается внести следующие изменения:
исключить такое условие приобретательной давности как добросовестность владения;уточнить, что право собственности на основании приобретательной давности возникает вне зависимости от того, признана ли соответствующая вещь бесхозяйной;ввести сокращенный срок (7 лет) приобретательной давности для линейных сооружений, являющихся опасными производственными объектами и (или) необходимыми для оказания услуг населению;установить, что течение срока приобретательной давности на недвижимые вещи, права на которые не зарегистрированы за гражданами или юридическими лицами, начинается со дня начала владения ими. Это положение, по замыслу авторов поправок, должно полностью заменить нынешнюю формулировку п. 4 ст. 234 ГК РФ, согласно которой течение срока приобретательной давности в отношении вещей, находящихся у лица, из владения которого они могли быть истребованы, начинается не ранее истечения срока исковой давности по соответствующим требованиям.предусмотреть, что если фактическое владение осуществлялось несколькими лицами, то в силу приобретательной давности у них может возникать общая долевая собственность на земельный участок или иную недвижимость.уточнить, что особенности приобретения в порядке приобретательной давности права собственности на земельные участки, находящиеся в государственной или муниципальной собственности, устанавливаются земельным законодательством.
Текст соответствующего проекта1 размещен на Федеральном портале проектов нормативных правовых актов для публичного обсуждения и антикоррупционной экспертизы, которые продлятся до 6 сентября 2019 года.
Корреспондирующие поправки планируется внести в земельное законодательство и законодательство о градостроительной деятельности.
