ФНС России на своем официальном сайте опубликовала информацию о старте нового пилотного проекта по сокращению сроков камеральной проверки по НДС до одного месяца. Такое решение было принято по результатам совместной с бизнесом работы. Сокращение срока камеральных проверок по НДС позволит добросовестным налогоплательщикам эффективнее распоряжаться оборотными капиталами, улучшит деловой климат, повысит их деловой активность и предоставит комфортные условия для их налогового администрирования.
Налоговая служба разъяснила особенности проведения проверки в сокращенный срок (письмо ФНС России от 6 октября 2020 г. № ЕД-20-15/129@).
Так, по истечении одного месяца со дня представления налоговой декларации, налогоплательщики, которые не применяют заявительный порядок возмещения налога и которые за последние три года уплатили НДС больше, чем заявили к возмещению по поданной декларации, оцениваются на одновременное соответствие ряду условий. В частности, в представленной декларации не должно быть ошибок и противоречий между сведениями, содержащимися в представленных документах, приводящих к изменению налоговых обязательств.
Также не должно быть противоречий или несоответствий между сведениями об операциях, содержащихся в налоговой декларации по НДС налогоплательщика и отчетности, представленной другим налогоплательщиком. Кроме того, должны отсутствовать признаки нарушений налогового законодательства, приводящих к завышению суммы налога, заявленной к возмещению из бюджета либо к занижению суммы налога, подлежащей уплате в бюджет.

Помимо этого, будет проводится оценка целесообразности проведения мероприятий налогового контроля в отношении контрагентов низкого и среднего уровня налогового риска, по которым налогоплательщиком заявлены налоговые вычеты по НДС.
