ФСС России не принял к зачету расходы страхователя на выплату пособия по уходу за больным ребенком (постановление АС Волго-Вятского округа от 17 марта 2020 г. № Ф01-8812/20). По мнению Фонда, страхователь надлежащим образом не подтвердил расходы на выплату пособия, так как пособие было назначено в отсутствие сведений о ненахождении второго родителя в отпуске по уходу за этим ребенком.
Не согласившись с решением Фонда, страхователь обратился в арбитражный суд. Требование страхователя о признании недействительным решения ФСС России было удовлетворено в суде апелляционной инстанции. Суд установил, что непредоставление справки с места работы матери ребенка о том, что она не находится в отпуске по уходу за этим ребенком, не является основанием для отказа в назначении пособия по временной нетрудоспособности.
В свою очередь, ФСС России, не согласившись с принятым судебным актом, обратился в Арбитражный суд Волго-Вятского округа с кассационной жалобой. Однако суд не нашел оснований для ее удовлетворения и пояснил, что апелляционный суд правомерно признал недействительным оспариваемое решение фонда.

Отметим, что об отсутствии обязанности родителя ребенка предоставлять иные документы, кроме листка нетрудоспособности, для назначения и выплаты пособия по уходу за больным ребенком уже сообщали Московское региональное отделение ФСС России и отделение по Республике Коми.

Today, I went to the beach with my children. I found
