Московская ГИТ ответила на вопрос о направлении в командировки работников из Белоруссии и Казахстана (Письмо ГИТ в г. Москве от 15 сентября 2020 г. № 77/10-36532-ОБ/18-1299).
Инспекторы напомнили, что согласно п. 1 Решения Высшего Совета Сообщества Беларуси и России от 22 июня 1996 г. № 4 действующий на основе национального законодательства порядок регулирования привлечения и использования иностранной рабочей силы в отношении граждан Республики Беларусь в Российской Федерации и граждан Российской Федерации в Республике Беларусь не применяется.
А в силу п. 1 ст. 97 Договора о Евразийском экономическом союзе работодатели государства-члена вправе привлекать к осуществлению трудовой деятельности трудящихся государств-членов без учета ограничений по защите национального рынка труда.

Таким образом, граждане Белоруссии и Казахстана имеют равные трудовые права с гражданами России, следовательно, срок их нахождения в командировке может ограничиваться только работодателем.
