В соответствии со вступившими в силу с 1 января 2019 года поправками в законодательство (Федеральный закон от 1 апреля 2019 г. № 48-ФЗ), органы Пенсионного Фонда РФ более не выдают застрахованным лицам свидетельства обязательного пенсионного страхования. Соответственно, были исключены из закона и упоминания об обязанности работодателя оформлять такие документы работникам, поступающим на работу впервые. Согласно новой редакции ст. 65 Трудового кодекса в случае, если на лицо, поступающее на работу впервые, не был открыт индивидуальный лицевой счет, работодатель обязан лишь представить в соответствующий территориальный орган ПФР сведения, необходимые для регистрации указанного лица в системе индивидуального (персонифицированного) учета (письмо Минтруда России от 17 мая 2019 г. № 21-3/В-574).
Тем не менее, В Федеральном законе от 1 апреля 1996 г. № 27-ФЗ «Об индивидуальном (персонифицированном) учете в системе обязательного пенсионного страхования» сохранилась норма, в соответствии с которой работодатель обязан получать в органах ПФР документы, подтверждающие регистрацию в системе индивидуального (персонифицированного) учета, и выдавать их под роспись застрахованным лицам.

Минтруд России в своем письме ответил на вопрос о том, в каких случаях на работодателя возлагается такая обязанность. Чиновники пояснили, что для открытия индивидуального лицевого счета гражданин подает в ПФР в том числе соответствующее заявление. Оно подается лично, через работодателя или через многофункциональный центр предоставления государственных и муниципальных услуг. В течение 5 рабочих дней ПФР принимает решение об открытии лицевого счета. О результатах регистрации гражданина в системе индивидуального (персонифицированного) учета ПФР обязан проинформировать его способом, указанным в обращении, путем направления документа, подтверждающего регистрацию в системе индивидуального (персонифицированного) учета и содержащего сведения о страховом номере индивидуального лицевого счета.
В случае подачи физическим лицом заявления через работодателя, информирование, а также выдача ему документа, подтверждающего регистрацию в системе индивидуального (персонифицированного) учета, осуществляется через указанного работодателя.
