По результатам плановой проверки управление Росстранснадзора в рамках своих полномочий вынесло учреждению предписание, в котором обязало учреждение устранить выявленные нарушения в сфере законодательства об автомобильном транспорте (Федеральный закон от 8 ноября 2007 г. № 259-ФЗ «Устав автомобильного транспорта и городского наземного электрического транспорта», Федеральный закон от 10 декабря 1995 г. № 196-ФЗ «О безопасности дорожного движения»), в том числе обеспечить заполнение путевых листов в соответствии с требованиями нормативных актов:
заполнять сведения о водителе;указывать дату и время проведения предрейсового и (или) послерейсового медосмотра;указывать Ф.И.О. медработника, проводившего осмотр (постановление Арбитражного суда Уральского округа от 5 августа 2019 Г. по делу № А60-1386/2018).
Оспаривая предписание в части заполнения путевых листов, учреждение пыталось доказать, что на него не распространяются требования Устава автомобильного транспорта и положения иных нормативных актов, относящихся к деятельности юридических лиц и ИП по перевозке пассажиров и грузов автотранспортом, так как оно осуществляет деятельность по обеспечению пожарной безопасности. Кроме того, учреждение сослалось на то, что при заполнении путевых листов руководствуется ведомственной Инструкцией.
Однако суд не принял доводы учреждения и согласился с проверяющими. При вынесении решения суд исходил из законности и обоснованности выданного в адрес учреждения предписания, так как все его пункты вынесены в целях обеспечения безопасности дорожного движения. В частности, суд указал, что заполнение путевого листа в соответствии с ведомственной Инструкцией направлено на учет использования техники и выполненной работы. Требование же предписания в части заполнения обязательных реквизитов путевых листов связаны с обеспечением безопасности движения, и указанные реквизиты подлежат заполнению при использовании техники, в том числе в учреждении (приказ Минтранса России от 18 сентября 2008 г. № 152 «Об утверждении обязательных реквизитов и порядка заполнения путевых листов»).
