Такой законопроект1 внесла на рассмотрение Госдумы группа депутатов. Они предлагают обязать правительство устанавливать базовые оклады и базовые ставки зарплаты для работников бюджетной сферы.
В настоящее время это не обязанность, а право правительства (ч. 2 ст. 144 ТК РФ) – однако оно этим правом не пользуется.
Авторы документа поясняют, что в 2007 году первый разряд единой тарифной сетки был оторван от МРОТ (Федеральный закон от 20 апреля 2007 г. № 54-ФЗ «О внесении изменений в Федеральный закон «О минимальном размере оплаты труда» и другие законодательные акты Российской Федерации»). Этим же законом права бюджетников были защищены: у правительства появилась обязанность принимать базовые оклады и базовые ставки зарплаты по профессиональным квалификационным группам. По сути это означает установление на федеральном уровне минимальных гарантий по зарплате работников бюджетной сферы, поскольку их зарплата не может быть меньше установленных базовых окладов и ставок.
Но через полгода были приняты поправки в ТК РФ (Федеральный закон от 18 октября 2007 г. № 230-ФЗ «О внесении изменений в отдельные законодательные акты Российской Федерации в связи с совершенствованием разграничения полномочий»), в результате которых эта обязанность правительства превратилась в право. Вместо слова «устанавливает» в ТК РФ теперь слова «может устанавливать» (ч. 2 ст. 144 ТК РФ).
Однако с 2007 года правительство ни разу это право не реализовало.
В результате, отмечают депутаты, в большинстве регионов сложилась структура зарплаты бюджетников, приводящая к значительной межрегиональной и внутрирегиональной дифференциации зарплаты работников одних и тех же специальностей и типов учреждений. Большой разрыв также между зарплатой руководителей и рядовых работников.
