Работник, узнав о том, что его оклад меньше, чем у коллеги, занимавшего ту же должность, обратился в суд, требуя от работодателя доначислить ему разницу в зарплате. По мнению истца, установление разных окладов для работников, занимающих одинаковые должности и выполняющих одинаковую трудовую функцию, является дискриминацией.
Суд претензии работника обоснованными не признал (Определение ВС Удмуртской Республики от 22.07.2019 по делу № 33-3229/2019). Установление должностного оклада является правом работодателя, определяется трудовым договором и зависит не только от квалификации работника, но и от сложности выполняемой работы, количества и качества затраченного труда.
В данном случае работодатель сумел доказать, что, несмотря на одинаковое наименование должности, обязанности работников отличались по своему содержанию. Таким образом, отличия в размере оклада были обусловлены сложностью выполнявшейся работниками работы, что не может считаться дискриминацией.
