Согласно нормам налогового законодательства при определении налоговой базы по НДФЛ учитываются все доходы налогоплательщика, полученные им как в денежной, так и в натуральной формах, или право на распоряжение которыми у него возникло (п. 1 ст. 210 Налогового кодекса).
Те же доходы, которые исключаются из налогообложения, указаны в отдельной статье. Так, к необлагаемым относятся доходы в виде субсидий (грантов в форме субсидий), источником финансового обеспечения которых являются бюджетные ассигнования федерального бюджета, полученные физлицом в 2020 году. Размер такой субсидии равен уплаченному гражданином в 2019 году налогу на профессиональный доход (п. 83 ст. 217 НК РФ).
Таким образом, как напоминает налоговая служба, субсидия, предоставляемая физлицам в целях возмещения расходов на уплату НПД за налоговые периоды 2019 года, не подлежит обложению НДФЛ (письмо ФНС России от 16 июня 2020 г. № БС-3-11/4536@).

Вместе с тем, плательщиками НПД, признаются те физлица, в том числе и предприниматели, которые перешли на специальный налоговый режим в установленном порядке (п. 1 ст. 4 Федерального закона от 27 ноября 2018 г. № 422-ФЗ, далее – Закон № 422-ФЗ). При этом, объектом обложения налогом не признаются доходы самозанятых, в том числе от реализации долей в уставном (складочном) капитале организаций, паев в паевых фондах кооперативов и паевых инвестиционных фондах, ценных бумаг и производных финансовых инструментов (п. 2 ст. 6 Федерального закона № 422-ФЗ).
