С 1 января вступила в силу норма, обязывающая микрофинансовые организации обеспечить взаимодействие с уполномоченным по правам потребителей финансовых услуг (Федеральный закон от 4 июня 2018 г. № 123-ФЗ «Об уполномоченном по правам потребителей финансовых услуг»). Организации, выполнившие эту обязанность, включаются в реестр, который ведет Банк России.
До предъявления организации, включенной в указанный реестр, иска о взыскании денежных средств в пределах 500 000 руб. гражданин-потребитель по общему правилу должен предварительно обратиться за разрешением спора к финансовому уполномоченному. В случае несогласия с решением уполномоченного гражданин сможет заявить свои требования в судебном порядке.
Напомним, что для граждан рассмотрение их обращений финансовым уполномоченным является бесплатным и по общему правилу осуществляется в заочной форме. В случае если финансовая организация не выполняет решение уполномоченного добровольно, оно может быть исполнено принудительно (через службу судебных приставов).
