К такому выводу пришли эксперты службы Правового консалтинга компании «Гарант» в рамках индивидуальной правовой консультации. Перед организацией встал вопрос: можно ли принять на работу иностранца на основании справки об отсутствии судимости, выданной иностранным государством, в частности Республикой Казахстан, в случае, когда ее предъявление является обязательным? Речь шла о приеме на работу в образовательную организацию. Специалисты обратили внимание на то, что для граждан Казахстана не предусмотрено каких-либо специальных исключений из общего правила. А следовательно, при трудоустройстве в России они обязаны предоставлять справку об отсутствии судимости и (или) факта уголовного преследования, либо о прекращении уголовного преследования по реабилитирующим основаниям, выданную уполномоченным органом МВД России.
В обоснование своей позиции они привели положения п. 6 ч. 1 ст. 65 Трудового кодекса, включающие в число документов, предъявляемых при устройстве на работу, связанную с деятельностью, до которой не допускаются лица, имеющие или имевшие судимость, а также подвергающиеся или подвергавшиеся уголовному преследованию, упомянутую справку, выданную именно МВД России. Напомним, что к такой трудовой деятельности относится деятельность в сфере образования, воспитания и развития несовершеннолетних (ст. 351.1 ТК РФ).
Кроме того, как отметили эксперты, если работодатель-юрлицо примет иностранного гражданина на работу без справки, выданной уполномоченным органом МВД России, то его должностных лиц могут оштрафовать на сумму от 1 тыс. до 5 тыс. руб., а его самого – на сумму 30 тыс. до 50 тыс. руб., причем возможная величина санкции для ИП за совершение этого правонарушения составляет от 1 тыс. до 5 тыс. руб. (ч. 1 ст. 5.27 КоАП).
