Минстрой России предлагает дополнить ч. 1 ст. 95 Федерального закона от 5 апреля 2013 г. № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд» новым п. 11, предусматривающим изменение условий контракта на выполнение строительных работ, срок исполнения которого составляет не менее одного года, в случае существенного изменения стоимости ценообразующих строительных ресурсов, которое привело к изменению общей стоимости строительства более чем на 5%. Указанное изменение не должно приводить к увеличению срока исполнения контракта и (или) цены контракта более чем на 30% (Проект Федерального закона «О внесении изменения в Федеральный закон «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд»).

Предполагается, что для изменения условий контракта в указанном случае потребуется подготовить соответствующее обоснование на основании решения органа власти. При этом порядок обоснования изменения существенных условий контракта в случае существенного изменения стоимости строительных материалов и (или) оборудования поставки подрядчиком установит Правительство Российской Федерации.
