Очередной этап судебного разбирательства между автономным учреждением, оплатившим из средств субсидии текущего года прошлогоднюю кредиторскую задолженность по коммунальным расходам, и ревизорами, расценившими этот факт как нецелевое использование средств, завершилось не в пользу проверяющих. Цена вопроса – более 1 млн.руб., которые учреждению удалось отстоять на двух этапах судебных слушаний.
По результатам рассмотрения кассационной жалобы судьи поддержали выводы нижестоящих судов о том, что претензии органа финансового контроля неправомерны (постановление АС Уральского округа от 16 марта 2020 по делу № А76-6432/2019). Субсидия на выполнение государственного / муниципального задания рассчитывается с учетом в том числе затрат на содержание имущества, закрепленного за учреждением. Направления расходования средств субсидий учреждение определяет самостоятельно в соответствии с Планом ФХД. И действия учреждения в данном случае направлены на исполнение возложенных на него обязанностей, поскольку оплата коммунальных платежей представляет собой содержание недвижимого имущества.
