Нормами налогового законодательства установлено, что сумма транспортного налога, подлежащая уплате налогоплательщиками-физлицами, исчисляется налоговыми органами на основании сведений, которые представляются органами, осуществляющими госрегистрацию транспортных средств (ст. 362 Налогового кодекса). Так, они сообщают сведения о транспортных средствах, зарегистрированных в этих органах (правах и сделках, зарегистрированных в этих органах), и об их владельцах в налоговые органы.
Поэтому, как поясняет налоговая служба, обязанность по уплате транспортного налога ставится в зависимость от государственной регистрации транспортного средства, а плательщиком транспортного налога признается лицо, на которое зарегистрировано транспортное средство. Иных оснований для прекращения взимания транспортного налога, за исключением случаев, когда транспортное средство не признается объектом налогообложения (в том числе находится в розыске) либо возникновения права на налоговую льготу, не установлено (письмо ФНС России от 24 июля 2020 г. № БС-2-21/1403@).
Также ФНС России напоминает, что объектом налогообложения по транспортному налогу признаются не только легковые и грузовые автомобили, но и водные и воздушные транспортные средства, которые не эксплуатируют дорожные покрытия (письмо ФНС России от 24 июля 2020 г. № БС-3-21/5421@).

Установленная в настоящее время налоговая база по налогу в зависимости от мощности двигателя транспортного средства способствует единообразному применению метода налогообложения ко всем автомототранспортным средствам, что соответствует принципам установления налогов, формам и методам налогового контроля и основным началам законодательства о налогах и сборах.
