Устройство второго этажа в квартире с достаточно высокими потолками является перепланировкой этой квартиры, а не реконструкцией здания. Кроме того, – хотя после такой перепланировки изменяется соотношение «общедомовых» и «частных» квадратных метров в МКД, а следовательно, уменьшается общее имущество МКД по отношению к общей увеличившейся площади всего МКД, – согласия соседей на эту перепланировку получать не нужно (письмо Минстроя России от 3 июля 2019 г. № 24456-ОГ/04).
С такой позицией выступил Минстрой России.
Отметим, что двухуровневые квартиры на последних этажах МКД – распространенная «изюминка» новостроек с оригинальной архитектурой. Покупатели таких квартир могут, по своему выбору, либо устроить дополнительный этаж и расширить квартиру, либо оставить шестиметровые потолки и любоваться «вторым» светом. При этом этажность самого МКД остается в пределах ограничений, предписанных разрешением на строительство МКД и градостроительным планом земельного участка.
