К такому выводу пришли эксперты службы Правового консалтинга компании «Гарант» в рамках индивидуальной правовой консультации. Они рассмотрели ситуацию, в которой за пациентку, больную сахарным диабетом первой степени, зарегистрированную по месту выписки бесплатных лекарств, но обучающуюся за границей, такие лекарства получала ее мать. Последняя получала их на основании соответствующей доверенности от совершеннолетней и дееспособной дочери. Мать девушки интересовал вопрос: могут ли ей отказать в выдаче лекарств, из-за того, что дочь не всегда лично присутствовала на приеме у врача? При этом выдача бесплатных лекарств в регионе (Республике Башкортостан) регламентируется специальным порядком.
Специалисты пояснили, что, с одной стороны, законный представитель вправе получить рецепт на лекарственный препарат с фиксацией этого факта в медицинской карте пациента (п. 5 Порядка организации предоставления мер социальной поддержки за счет средств бюджета Республики Башкортостан отдельным группам и категориям граждан в части обеспечения лекарственными препаратами и изделиями медицинского назначения по рецептам врачей при оказании амбулаторно-поликлинической помощи, прил. № 2 к приказу Минздрава России от 20 декабря 2012 г. № 1175н). Но, с другой стороны, в соответствии с п. 7 Порядка врач (фельдшер) выписывает лекарственные препараты и изделия медицинского назначения при обращении гражданина по результатам осмотра. Таким образом, отмечают эксперты, поскольку пациентка не является лично на прием к врачу, то он не вправе выдавать рецепт ее представителю.
Вместе с тем они напомнили о праве лиц, имеющих доверенность от пациента, получать наркотические и психотропные лекарственные препараты (п. 20 Правил отпуска лекарственных препаратов для медицинского применения, в том числе иммунобиологических лекарственных препаратов). Специалисты не исключили возможность применения указанного права по аналогии к выдаче бесплатных лекарств представителю по доверенности, а при возникновении спорных ситуаций рекомендовали обращаться непосредственно в Минздрав России.
