Собственник машино-места судился со «стояночным» ТСН по вопросу содержания общего имущества. Собственник полагал, что взносы на капремонт, коммунальные платежи и прочие элементы платы нужно считать исходя из площади, собственно, самого машино-места (Определение Конституционного Суда РФ от 19 декабря 2019 г. № 3461-О).
ТСН, которого поддержал орган ГЖН, напротив, исчислял платежи исходя из доли собственника в праве на общее имущество ТСН – то есть на проезды, развороты и прочие части парковки, без которых пользоваться машино-местом будет нельзя, а содержать их все-таки надо.
Собственник настаивал, что, поскольку паркинг со спорным машино-местом находится в подвальном помещении МКД, то все эти «дорогие» развороты, проезды и прочие пространства являются общим имуществом собственников помещений МКД. С такими расчетами площадь, на которую начислялись бы платежи, значительно уменьшилась бы для владельцев машино-мест, но, правда, подросла бы для владельцев квартир «наверху».
Суд, однако, был на стороне ТСН, потому что:
покупая машино-место, истец купил именно долю в праве общей долевой собственности на нежилые помещения, расположенные в подземном паркинге в МКД;на общем собрании собственников паркинга принято решение о выделе в натуре машино-мест из своих долей согласно договорам купли-продажи по существующей разметке в соответствии с проектом паркинга. Площадь паркинга, оставшуюся после выдела машино-мест, решили передать в общедолевую собственность всего МКД;однако на момент суда еще не все собственники выделили свое машино-место в натуре, следовательно, право общей долевой собственности на помещение паркинга не прекратилось,а значит, собственник несет бремя содержания такого имущества в объеме, существовавшем до выдела машино-места, согласно ч. 4 ст. 6 Федерального закона от 3 июля 2016 года № 315-ФЗ «О внесении изменений в часть первую ГК РФ».
Именно эта норма и стала предметом жалобы собственника в Конституционный Суд РФ. Однако КС РФ не принял ее к рассмотрению, поскольку оспариваемое положение направлено на обеспечение сохранности имущества, равенства прав долевых собственников как парковки, так и собственников отдельных машино-мест, отвечает интересам собственников и пользователей данного имущества и само по себе не может расцениваться как нарушающее указанные в жалобе конституционные права заявителя.
