Специалисты Роструда ответили на вопрос о том, как работодателю определять количество дней отпуска, на которое имеет право работник, в ситуации, когда в течение рабочего года продолжительность дополнительного отпуска за ненормированный рабочий день была увеличена (Обзор актуальных вопросов от работников и работодателей за сентябрь 2020 года (информационный портал Роструда «Онлайнинспекция.РФ»). В консультации отмечается, что законодательством порядок расчета продолжительности отпуска для такой ситуации не установлен. По мнению чиновников, расчетный период для всех видов оплачиваемых отпусков (как основного, так и дополнительного) следует исчислять со дня фактического приема работника на работу, а дополнительный отпуск в рабочем периоде каждого работника должен быть рассчитан пропорционально периоду до увеличения его продолжительности и после.

Полагаем, что справедливость такого подхода косвенно подтверждается п. 21 Постановления Пленума Верховного Суда РФ от 28 января 2014 г. № 1, в котором также закреплен принцип пропорциональности при изменении продолжительности отпуска, но применительно к случаям утраты работником статуса несовершеннолетнего и, как следствие, права на удлиненный отпуск в 30 дней.
