Отдельный раздел в Обзоре Верховного Суда РФ, посвящен тому, как применять недавно введенные в Закон о банкротстве положения о моратории на возбуждение дел о банкротстве в связи с распространением COVID-19 (обзор по отдельным вопросам судебной практики…№ 1 (утв. Президиумом Верховного Суда РФ 21 апреля 2020 г.)).
Верховный Суд РФ пояснил, что включение должника в перечень лиц, на которых распространяется мораторий, является само по себе достаточным основанием для возврата арбитражным судом заявления кредитора о признании должника банкротом. Обстоятельства возникновения задолженности должника перед кредиторами (в том числе причины, связь с основанием для введения моратория), а также период ее возникновения значения не имеют.
Рассмотрение вопросов о восстановлении сроков на предъявление кредиторами требований по делу о банкротстве и (или) признание соблюденными сроков на совершение иных действий по делу о банкротстве следует производить с учетом фактических обстоятельств каждого конкретного дела.

Закон о банкротстве предусматривает, что на срок действия моратория в отношении должников, на которых он распространяется, приостанавливается исполнительное производство по имущественным взысканиям по требованиям, возникшим до введения моратория (при этом не снимаются аресты на имущество должника и иные ограничения в части распоряжения имуществом должника, наложенные в ходе исполнительного производства). Верховный Суд РФ не увидел в Законе о банкротстве запрета на рассмотрение в период действия моратория исков к должникам, на которых он распространяется, а из указанных положений Закона пришел к выводу, что судом могут выдаваться исполнительные листы по имущественным взысканиям в отношении должников, на которых распространяется мораторий. При этом в ходе исполнительного производства по данным исполнительным листам допустимо совершение действий по ограничению распоряжением имуществом должника, предусмотренных законодательством об исполнительном производстве.
