Минюст России уведомляет на своем официальном сайте1, что правительство одобрило законопроект, который сделает работу приставов более эффективной.
Так, в случае принятия поправок банки будут должны сообщать в ФССП России о том, что гражданин погасил свою задолженность, в режиме реального времени. Максимум — в течение часа после принятия платежа. Это даст возможность приставам максимально быстро снять наложенные ограничения, в том числе на выезд из России.
Сегодня за пределы страны не могут выехать должники с суммой задолженности от 30 тыс. руб. (для некоторых требований, например, по алиментам или возмещению вреда здоровью — свыше 10 тыс. руб.) либо с неисполненными требованиями неимущественного характера. Причем если гражданин не рассчитывается по своим долгам более двух месяцев, пристав вправе снизить минимальную границу задолженности с 30 тыс. до 10 тыс. руб. (ч. 1-2 ст. 67 Федерального закона от 2 октября 2007 г. № 229-ФЗ «Об исполнительном производстве»).

Кроме того, решения по некоторым вопросам исполнительного производства, возможно, станут приниматься в автоматическом режиме. Речь о возбуждении и отказе в возбуждении исполнительного производства, взыскании исполнительского сбора, установлении и отмене ограничений и т. д. При этом пристав сможет отменить любое из решений, принятых автоматически, если оно не соответствует закону.
Напомним, что с февраля на портале госуслуг работает новый сервис, который позволяет узнать информацию о ходе исполнительного производства в онлайн-режиме. Так, можно получить сведения о причине и сумме задолженности, наложенных на должника ограничениях, действиях судебных приставов по исполнительному производству и т. д.
