В связи с увеличением количества обращений граждан с жалобами на затягивание оформления договора ОСАГО страховыми компаниями, Банк России напомнил страховщикам о сроках его заключения (информация Банка России от 24 января 2020 г.).
Сообщается, что договор ОСАГО – при отсутствии законных оснований для отказа в его заключении – должен быть заключен в тот же день, когда владелец транспортного средства обратился с соответствующим заявлением в страховую компанию, представил все требуемые документы и оплатил страховую премию.
Если заявление оформлено с недочетами и/или представлен неполный комплект документов, страховщик должен немедленно (в тот же день) сообщить об этом владельцу ТС либо оформить договор ОСАГО.
При оформлении электронного полиса страховщик по общему правилу самостоятельно получает требуемые сведения через систему информационного обмена и межведомственного взаимодействия с соответствующими структурами и после оплаты страховой премии должен незамедлительно выслать полис страхователю в виде электронного документа.
Кроме того, Банк России напомнил страховщикам, что необоснованный отказ в заключении договора ОСАГО либо затягивание его оформления влечет за собой применение административных мер (см. ст. 15.34.1 КоАП).
