Соответствующий приказ Минздрава России о внесении изменений в порядок проведения обязательного медицинского освидетельствования водителей транспортных средств (кандидатов в водители транспортных средств), утвержденный приказом Минздрава России от 15 июня 2015 г. № 344н (далее – порядок медосвидетельствования) опубликован 11 ноября на официальном интернет-портале правовой информации.
Изменения предусматривают направление водителя на дополнительное медицинское обследование, которое включает в себя, помимо обследования психиатром-наркологом, обязательное инструментальные лабораторные исследования для диагностики употребления психоактивных веществ и заболеваний (состояний), препятствующих управлению транспортными средствами. Напомним, сегодня исследование биологических жидкостей проводится только в том случае, если психиатр-нарколог предварительно усмотрит у водителя симптомы таких заболеваний (подп. 8, подп. 9 п. 6 порядка медосвидетельствования).
Принятые изменения детально описывают процесс лабораторного исследования. Так, при наличии оснований, выявленных в ходе предварительного химико-токсикологического исследования (далее – ХТИ), на наличие метаболитов и их аналогов: опиатов, каннабиноидов, фенилалкиламинов (амфетамина, метамфетамина), синтетических катинонов, кокаина, метадона, бензодиазепинов, барбитуратов и фенциклидинов и их производных, объект исследования будет направлен для проведения подтверждающих ХТИ, которые проводятся путем газовой и (или) жидкостной хроматографии.
Наличие симптомов (синдромов) заболевания и результаты исследований биожидкости, как в совокупности, так и самостоятельно друг от друга могут быть расценены психиатром-наркологом в качестве оснований для назначения медобследования в специализированной медорганизации для установления психических расстройств или расстройств поведения, связанных с употреблением психоактивных веществ. В наиболее сложных ситуациях решение о наличии (отсутствии) указанных расстройств примет врачебная комиссия в составе психиатра-нарколога, терапевта и невролога.
Соответствующие изменения вступят в действие с 22 ноября 2019 года.
