В случае, когда по условиям трехстороннего договора учреждение создает сотруднику, получившему грант, условия, необходимые для реализации научного проекта, а за это грантополучатель компенсирует ему понесенные расходы, поступившие учреждению средства компенсации в налоговую базу по НДС не включаются (письмо Департамента налоговой и таможенной политики Минфина России от 11 февраля 2019 г. № 03-07-11/8032).
Во-первых, получение этих денежных средств не связано с оплатой товаров, работ, услуг, подлежащих обложению НДС (п. 1 ст. 162 Налогового кодекса).

Во-вторых, от налогообложения налогом на добавленную стоимость освобождаются научно-исследовательские работы и опытно-конструкторские работы, выполняемые за счет средств РФФИ (подп. 16 п. 3 ст. 149 НК РФ). При этом, по мнению Минфина России, сказанное относится как к исполнителям, так и к соисполнителям этих работ, в качестве которого в данном случае и выступает учреждение.
